USLegal Newsletter July 2019 – How to File a Claim in the Equifax Data Breach Settlement

The Federal Trade Commission (FTC) announced an agreement with Equifax this month for consumers to receive $575 million and up to $700 million to settle complaints that had been brought because of a massive data breach. More than 147 million people had their personal information exposed during a cyber attack which occurred in 2017. The FTC, the Consumer Financial Protection Bureau (CFPB), and 50 U.S. states and territories alleged that the credit bureau “did not take reasonable steps to secure its network.”

As part of the proposed settlement, consumers can make the following claims if they are able to meet certain eligibility requirements:

  • Receive a cash payment of $125 or receive 4 to 6 years of free credit monitoring
  • Receive cash payments up to $20,000 for out-of-pocket losses and time spent recovering from identity theft and fraud caused by the breach
  • Receive seven years of free identity theft restoration services if they were harmed by the breach
  • All U.S. consumers are eligible for free credit reports from Equifax for 7 years starting in 2020.
